1. General provisions

1.1. These Terms and Conditions govern the rights and obligations arising in connection with purchase agreements concluded between Mgr. Ing. Jaroslav Knápek (hereinafter referred to as the “Seller”) and customers (hereinafter referred to as the “Buyer”) through the XCSPORT.cz online store.

1.2. The online store is operated by the Seller at www.xcsport.cz through its web interface.

1.3. A Consumer is a natural person who, outside the scope of their business or professional activity, enters into a contract with the Seller or otherwise deals with the Seller. Where these Terms and Conditions grant specific rights to Consumers, such provisions apply only to Buyers who qualify as Consumers under applicable law.

1.4. These Terms and Conditions also apply to Buyers acting in the course of their business activities, except for provisions which by law apply exclusively to Consumers.

1.5. Provisions agreed individually in a purchase agreement take precedence over these Terms and Conditions.

1.6. These Terms and Conditions form an integral part of the purchase agreement.

1.7. The Seller may amend or supplement these Terms and Conditions. Any amendment does not affect rights and obligations arising while a previous version was in force.

2. Customer account

2.1. The Buyer may create a customer account by registering on the online store. Where permitted by the web interface, the Buyer may also place an order without registration.

2.2. When registering and placing an order, the Buyer must provide accurate, complete and truthful information. The Buyer is responsible for keeping the information in their customer account up to date.

2.3. Access to the customer account is protected by login credentials. The Buyer is responsible for keeping these credentials confidential and must not allow unauthorised third parties to use the account.

2.4. The Seller may suspend or cancel a customer account, in particular where the Buyer seriously breaches their obligations or the account has remained unused for an extended period.

2.5. The Buyer acknowledges that the customer account may occasionally be unavailable due to maintenance, technical reasons or maintenance of systems operated by third parties.

3. Placing an order and conclusion of the purchase agreement

3.1. Information about products displayed in the online store, including their main characteristics, availability and price, is provided through the web interface.

3.2. Product prices are displayed including VAT where applicable. Shipping costs and any other applicable charges are shown separately during checkout before the Buyer submits the order.

3.3. To place an order, the Buyer selects the goods and adds them to the shopping cart, selects the available delivery and payment methods and provides the information required to process and deliver the order.

3.4. Before submitting the order, the Buyer has the opportunity to check and correct the information entered in the order.

3.5. By submitting an order using the button indicating that the order entails an obligation to pay, the Buyer submits a binding order.

3.6. After receiving the order, the Seller sends an electronic confirmation to the email address provided by the Buyer.

3.7. Depending on the nature of the order, including the quantity of goods, total price, availability or shipping requirements, the Seller may request additional confirmation from the Buyer.

3.8. The Seller may refuse or cancel an order where there is a legitimate reason to do so, in particular where the goods are no longer available, the displayed price is clearly erroneous, delivery is not possible, or the Buyer fails to make a required payment. If the Buyer has already paid, the Seller will refund the corresponding amount without undue delay.

3.9. The Buyer agrees to the use of means of distance communication for the conclusion of the purchase agreement. The Buyer bears their own costs associated with the use of such means of communication, which do not differ from the standard rates charged by their service provider.

4. Prices and payment

4.1. The Buyer shall pay the price of the goods and any shipping or other charges shown during checkout.

4.2. Available payment methods depend on the destination country and selected delivery method and may include, in particular:

  • online payment by card,
  • bank transfer,
  • cash on delivery where available,
  • cash payment when collecting the goods in person where available.

4.3. The payment methods currently available to the Buyer and any related fees are displayed during checkout before the order is submitted.

4.4. In the case of payment by bank transfer, the payment obligation is fulfilled when the corresponding amount is credited to the Seller's account.

4.5. The Seller may require full payment of the purchase price before dispatching the goods.

4.6. Unless expressly stated otherwise, discounts, promotional offers and discount codes cannot be combined.

4.7. The Seller issues an invoice or other tax document in accordance with applicable law. The document may be provided electronically.

4.8. The price applicable to the purchase agreement is the price displayed and confirmed as part of the order, subject to cases of an obvious pricing error.

Detailed information about available delivery and payment methods is provided on the Shipping & Payment page of the online store.

5. Delivery

5.1. Available delivery methods and shipping costs are displayed during checkout and depend on the destination, parcel dimensions, weight and selected delivery method.

5.2. The Buyer must provide a complete and correct delivery address and other information required for delivery.

5.3. If repeated delivery or another delivery method is required for reasons attributable to the Buyer, the Buyer may be required to pay the reasonable additional costs incurred.

5.4. Long or oversized products, including certain cross-country skis, roller skis, ski poles and other long items, may be subject to specific shipping conditions and may not be available for all delivery methods or destinations.

5.5. Upon receiving a parcel, the Buyer is advised to check the condition of the packaging. If the parcel is visibly damaged, the Buyer should, where possible, report the damage to the carrier and contact the Seller as soon as possible.

5.6. Failure to report visible transport damage immediately does not deprive a Consumer of their statutory rights.

6. Consumer right of withdrawal

6.1. A Consumer who concludes a purchase agreement through the online store generally has the right to withdraw from the agreement within 14 days without giving any reason, unless an exception provided by law applies.

6.2. For goods, the withdrawal period generally expires 14 days after the day on which the Consumer, or a third party designated by the Consumer other than the carrier, takes possession of the goods.

6.3. Where a single order contains several goods delivered separately, the withdrawal period generally runs from receipt of the last item, part or piece, as applicable under the law.

6.4. To exercise the right of withdrawal, the Consumer must inform the Seller of the decision to withdraw by an unequivocal statement before the withdrawal period expires.

The notification may be sent to:

XCSPORT.cz
Horní Heřmanice 176
561 33 Horní Heřmanice
Czech Republic
Email: info@xcsport.cz
Phone: +420 732 655 668

6.5. The Consumer may use the withdrawal form provided by the Seller, but use of the form is not mandatory.

6.6. After withdrawing from the agreement, the Consumer must return the goods without undue delay and no later than 14 days after notifying the Seller of the withdrawal.

6.7. Unless the Seller has agreed otherwise or is responsible for the reason for the return, the Consumer bears the direct cost of returning the goods.

6.8. The Seller shall refund all payments received from the Consumer in connection with the purchase agreement, including the cost of delivery corresponding to the least expensive standard delivery method offered by the Seller, in accordance with applicable law.

6.9. If the Consumer selected a delivery method more expensive than the least expensive standard delivery method offered by the Seller, the Seller is not required to refund the additional cost resulting from that choice.

6.10. The refund will generally be made using the same payment method used for the original transaction unless another method has been agreed and the Consumer does not incur additional costs.

6.11. The Seller may withhold the refund until the goods have been received back or until the Consumer provides evidence that the goods have been sent back, whichever occurs first.

6.12. The Consumer is liable only for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

Exceptions to the right of withdrawal

6.13. The right of withdrawal does not apply in cases specified by applicable law, including, in particular, goods made to the Consumer's specifications or clearly personalised, goods which deteriorate or expire rapidly, and sealed goods which are not suitable for return for health protection or hygiene reasons if they have been unsealed after delivery.

7. Returns and exchanges

7.1. Detailed information and step-by-step instructions for returning or exchanging goods are available on our Returns, Exchanges and Complaints page.

7.2. The Consumer may use the return shipping service offered by the Seller where available. The applicable return shipping fee depends on the country from which the parcel is sent. Current return shipping options and fees are listed on the Returns, Exchanges and Complaints page.

7.3. Where a return is caused by an error on the Seller's part, such as dispatching an incorrect product or size, the Consumer should contact the Seller before returning the goods. The Seller will bear the reasonable return shipping costs in such cases.

7.4. If the Buyer wishes to exchange an item for another size or product, the Seller may recommend returning the original item and placing a new order.

8. Defective goods and complaints

8.1. The Seller is responsible for ensuring that goods supplied to Consumers conform to the purchase agreement in accordance with applicable law.

8.2. In particular, the goods must have the agreed description, type, quantity, quality, functionality and other agreed characteristics and be suitable for the agreed or usual purpose, subject to the requirements of applicable law.

8.3. A Consumer may exercise statutory rights in respect of a lack of conformity that becomes apparent within two years of delivery of the goods, subject to the conditions and exceptions provided by applicable law.

8.4. Depending on the circumstances and applicable law, the Consumer may be entitled to have the goods repaired or replaced and, where the statutory conditions are met, to receive an appropriate price reduction or withdraw from the purchase agreement.

8.5. Statutory rights relating to defective goods do not apply to defects caused by normal wear and tear, improper use, mechanical damage caused by the Buyer, improper maintenance or other circumstances for which the Seller is not responsible. They also do not apply to a defect for which a lower price was specifically agreed.

8.6. Detailed instructions on how to make a complaint, including information about returning defective goods, are available on our Returns, Exchanges and Complaints page.

8.7. Complaints may also be submitted directly to:

8.8. When submitting a complaint, the Buyer should provide information allowing the Seller to identify the order and describe the defect. Photographs may help the Seller assess the issue more quickly.

8.9. The Buyer should contact the Seller before sending defective goods where reasonably possible, so that the Seller can provide instructions regarding the appropriate return method.

8.10. For a justified complaint, the Seller shall bear or reimburse reasonable costs associated with exercising the Consumer's statutory rights, in accordance with applicable law.

9. Ownership and risk

9.1. Ownership of the goods passes to the Buyer upon full payment of the purchase price and delivery of the goods, subject to applicable mandatory law.

9.2. For Consumers, the risk of loss or damage passes in accordance with mandatory consumer protection law, generally when the Consumer or a third party designated by the Consumer takes possession of the goods.

10. Personal data and commercial communications

10.1. The Seller processes personal data in accordance with the General Data Protection Regulation (EU) 2016/679 (GDPR) and other applicable data protection legislation.

10.2. Information about the processing of personal data, purposes of processing, legal bases, retention periods and the Buyer's rights is provided in the Seller's separate privacy policy.

10.3. Personal data necessary for processing an order may be provided to service providers involved in fulfilling the purchase agreement, in particular payment service providers, carriers and providers of the technical infrastructure of the online store, to the extent necessary for the relevant purpose.

10.4. Commercial communications are sent in accordance with applicable law. Where consent is required, the Buyer may withdraw that consent at any time.

10.5. Information about the use of cookies and similar technologies is provided separately on the website and, where required, through the cookie consent settings.

11. Complaints and out-of-court dispute resolution

11.1. The Buyer may send complaints concerning the purchase agreement or the Seller's services to info@xcsport.cz.

11.2. For Consumers, the competent entity for out-of-court resolution of consumer disputes in the Czech Republic is:

12.1. These Terms and Conditions and purchase agreements concluded through XCSPORT.cz are governed by the laws of the Czech Republic.

12.2. Where the Buyer is a Consumer residing in another country, the choice of Czech law does not deprive the Consumer of protection afforded by mandatory provisions of the law that would apply in the absence of such choice.

12.3. Nothing in these Terms and Conditions is intended to limit or exclude statutory Consumer rights that cannot legally be limited or excluded.

13. Final provisions

13.1. If any provision of these Terms and Conditions is or becomes invalid or unenforceable, this does not affect the validity of the remaining provisions.
